In a significant but secret move, Punjab has recommended deletion of the names of 46 individuals from the Union government's “blacklist“, including top Khalistan protagonists and former militants not involved in any criminal case in India, it is learnt. Of those sought to be de-listed, 39 are Punjab-origin expatriates who have been denied Indian visa since the 1980s because of their pro-Khalistan activities abroad, while seven are one-time militants currently residing in Punjab.

Notable among them are Gurmit Singh Aulukh and Ganga Singh Dhillon, both US nationals and long-time campaigners for a separate Sikh state; Canada residents Ajaib Singh Bagri, a Babbar Khalsa International (Parmar) activist who was tried for the Kanishka airliner bombing, and Avtar Singh, alias Tari, of the Khalistan Liberation Force, besides Shingara Singh and Resham Singh, both top Babbar Khalsa leaders settled in France and Germany, respectively.

The de-listing recommendation is in response to the blacklist of 169 names that the Ministry of Home Affairs (MHA) had forwarded to Punjab on May 17. The Badal government's recommendation has clear political overtones in the backdrop of the party's vociferous stand for scrapping the blacklist -a move likely to be interpreted as an attempt to pander to the Sikh radicals in the wake of the upcoming high-stakes Shiromani Gurdwara Parbandhak Committee (SGPC) elections. In fact, Chief Minister Parkash Singh Badal had raised the black/negative list that has been under tight wraps all these years, issue in the presence of Prime Minister Manmohan Singh during the CMs' conference on internal security on February 7 this year.

Badal had demanded the names of all those on the black/negative list be put on the official website of the Ministries of External Affairs, Home Affairs and the Indian Overseas Affairs so that unnecessary harassment was not caused to such people on arrival in India and they could get an opportunity playing the name game 169 Total names of Sikhs received from Centre for review 28 Should face their cases on return, says Punjab 84 Names not clearly identified, addresses demanded 11 Not from state to make a representation in their defence to an appropriate authority.

The issue of blacklist has long been agitating Sikh expatriates and had lately become the central plank of foreign based extremist elements' shrill anti-India rhetoric, particularly in Canada.

The MHA had sent to Punjab a CD containing “consolidated and updated blacklist (as on 14/05/2010)“ of 185 names for review and recommendation. However, the review revealed there were actually only 169 names, as two persons' names had been repeated thrice, and 12 persons' twice. The names were closely scrutinised by state intelligence agencies under the direct supervision of Deputy Chief Minister Sukhbir Singh Badal who looks after the Home Department.

In its two-page “secret“ letter to the Foreign Division of the MHA, the Shiromani Akali Dal-BJP government has also indirectly taken up the case of another 28 persons who figure in the blacklist and are wanted in terrorist or heinous criminal cases in Punjab. The government has said that they “on their return to India should face their respective cases registered against them, as per the law of land“.

“However, [if there is] anyone who contends the registration of a case against him is false, it is proposed to provide such person an opportunity for making a representation to the Home Department for getting an inquiry conducted,“ says the official communication. Punjab has also asked the Union Home Ministry to provide complete addresses of another 84 persons on the blacklist, whose identity could not be established due to incomplete addresses.

On the remaining 11 persons belonging to other states, Punjab has suggested the comments be sought from the authorities concerned. The Badal government has sought assurance from the Centre that the list provided to the state “is final and conclusive“, and that there is no other list that debars Sikh NRIs from visiting India.

this should be rewritten as...denied visa because of exercising their right to freedom of speech.
